Yesterday I was at a hearing. There was this old man – maybe in his 50s or 60s – and he was speaking to the Prosecutor about a case he, his wife and his sibling had filed against some man who had apparently gotten them for 550k. The thing is, there were apparently 2 contracts, one between him/his wife and the sob, and the other between his sibling and the sob. The one that got filed with the prosecutor was only his sibling’s (I don’t know if it was a brother or sister) and the contract was for 50k (I don’t know what the contract was for, either). His contract, the one for 500k – had never gotten filed.
It was so sad. The only thing he wanted to know was whether it would still be worth it to pursue the case, as apparently, he needed the money more than he needed the sob jailed. (which is usually the case isn’t it?)
The prosecutor told him it wasn’t his (the prosecutor’s) fault the case hadn’t been filed, in truth, it probably isn’t. but somewhere down the line, someone had gotten their lines crossed since the cases had apparently been endorsed to the prosecutor from another gov’t agency (was I the SEC? I was only eavesdropping). Anyway, the prosecutor could only tell him that he could refile the case (can't just amend - it's a criminal case, accused was already arraigned, double jeopardy had set it, etc), and that he (the prosec) could get a conviction but he wouldn’t know if the sob would have the money to pay up.
The old man’s face – I never thought I’d get to write that down – was a picture of despair, it was very nearly pathetic. I wanted to tell him (he was sitting beside me) to let it go; but how do you tell someone who’s had some life-defining thing happen to him (probably lost all his savings from when he went to Saudi – that his wife had been coming to the hearings previously because he’d been in Saudi, I overheard that too) that that’s it?
Everyone should have second chances. I hope he finds some way to get one.
I was so sad.
(of course, I went back to the office, forgot all about it, until it was time to sleep and then started thinking about it. I never want to be in that position. It’s so scary and sad.)
